Definitions

• "getsurespace," "we," "us," or "our" refers to getsurespace Technologies Ltd.
• "User," "you," or "your" refers to any individual or entity that accesses or uses the Services.
• "Landlord" refers to a user who owns or manages rental properties and offers them for rent through the Services.
• "Tenant" refers to a user who is seeking to rent or is renting a property listed on the Services.
• "Property" refers to any real estate listed for rent on the Services.
• "Content" refers to any information, text, graphics, photos, or other materials uploaded, downloaded, or appearing on the Services.

Eligibility

To use the Services, you must be at least 18 years old and capable of forming a binding contract with getsurespace. You must also not be prohibited from receiving services under the laws of Nigeria or other applicable jurisdiction.

If you are using the Services on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" will refer to that entity.

Account Registration and Security

To access certain features of the Services, you may need to create an account. When registering for an account, you must provide accurate and complete information. You are responsible for maintaining the security of your account and password. getsurespace cannot and will not be liable for any loss or damage resulting from your failure to comply with this security obligation.

You are responsible for all activities that occur under your account. You agree to notify getsurespace immediately of any unauthorized use of your account or any other breach of security.

getsurespace Services

For Landlords

getsurespace provides landlords with tools to list properties, screen potential tenants, manage leases, collect rent, and communicate with tenants. Landlords are responsible for ensuring that their property listings are accurate and comply with all applicable laws and regulations.

For Tenants

getsurespace provides tenants with tools to search for properties, apply for rentals, sign leases, pay rent, and communicate with landlords. Tenants are responsible for ensuring that the information they provide during the application process is accurate and complete.

Service Limitations

getsurespace does not guarantee the availability, quality, safety, or legality of any properties listed on the platform. getsurespace does not own, manage, or control any properties listed on the platform. getsurespace is not a party to any agreements between landlords and tenants.

Fees and Payments

getsurespace may charge fees for the use of certain services. All fees are stated in Nigerian Naira (NGN) unless otherwise specified. You agree to pay all fees and charges incurred in connection with your use of the Services.

getsurespace reserves the right to change its fees and pricing at any time. Any changes to fees will be posted on the platform and will take effect immediately for new users and 30 days after posting for existing users.

Payments made through the platform are processed by third-party payment processors. By using these payment services, you agree to comply with the terms and conditions of these payment processors.

Property Listings and Rentals

For Landlords

Landlords are responsible for ensuring that their property listings are accurate, complete, and comply with all applicable laws and regulations. Landlords must have the legal right to list and rent the properties they post on the platform.

Landlords agree not to discriminate against any tenant based on race, color, religion, sex, national origin, disability, familial status, or any other characteristic protected by law.

For Tenants

Tenants are responsible for reading and understanding the terms of any rental agreement before signing. getsurespace does not guarantee that a rental property will meet a tenant's expectations or requirements.

User Content and Conduct

You are solely responsible for the content you post on the platform, including property listings, reviews, comments, and messages. You agree not to post content that is illegal, fraudulent, misleading, defamatory, obscene, or otherwise objectionable.

You agree not to use the Services to:

• Violate any applicable law or regulation
• Infringe on the rights of others
• Distribute malware or other harmful code
• Interfere with the operation of the Services
• Collect or store personal data about other users without their consent
• Engage in any activity that could damage, disable, overburden, or impair the Services

getsurespace reserves the right to remove any content that violates these Terms or that getsurespace finds objectionable for any reason, without prior notice.

Intellectual Property Rights

The Services and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of getsurespace and its licensors. The Services are protected by copyright, trademark, and other laws of Nigeria and foreign countries.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without the express written permission of getsurespace.

Termination

getsurespace reserves the right to terminate or suspend your account and access to the Services at any time, for any reason, without prior notice or liability. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

getsurespace DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

IN NO EVENT SHALL getsurespace, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

Indemnification

You agree to indemnify, defend, and hold harmless getsurespace and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to your use or misuse of the Services, your violation of these Terms, or your violation of any rights of another.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Nigeria.

Changes to Terms

getsurespace reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
